On 4th September 2013, TRR released its draft analysis on the revision of TVL’s dominance in the retail mobile market. TVL is a dominant player in various telecommunications market, including fixed and mobile retail market. TVL was designated dominant, inter alia, in the retail mobile market in March 2008 by the interim Regulator at that time. TVL’s dominance was made under clause 10.1 and 10.2 of its Licence.
On 4th February 2013, TVL requested TRR to review its dominance position in the retail mobile market pursuant to clause 10.3 of its Licence. TRR has undertaken its analysis, and has released its draft preliminary analysis for consultation. This has limited to both TVL and Digicel only, before TRR makes a decision under the Telecommunications and Radiocommunications Regulation Act 2009. Importantly however, TRR’s decision will be made public.
A similar analysis was made by TRR for Digicel after Digicel requested, in April 2011, a review of its dominance position (as designated in 2009) in the retail mobile market and wholesale market pursuant to clause 10.3 of its Licence. After conducting the review and analyzing the evidence, TRR, on 16 July 2012, issued its decision, upholding the designation Order which designating Digicel continue to be dominance those markets pursuant to clause 10.3 of its licence.
