TRR issued this notice in accordance with clause 8.12(c) of the Competition Guideline, where it stated that “If TRR decides to accept the complaint, send a copy of the non-confidential filing….to the service provider whose conduct is the subject of the complaint and publish a notice on its website announcing the investigation”.
In early November 2012, Telecom Vanuatu Limited (TVL) formally lodged a complaint to TRR for investigation. In its complaint, TVL alleged some conduct of Digicel (Vanuatu) Limited to be in violation of section 23 of the Telecommunications and Radiocommunications Regulation Act 2009. After initially reviewing the complaint, TRR accept the complaints and forward a non-confidential copy to Digicel for response before TRR make a final determination. The investigation is now in process.
