All individuals, businesses, and small to medium-sized entities engaged in the provision, operation, or resale of telecommunications services, including internet services, are required to ensure that such activities are duly registered, authorised, or licensed in accordance with applicable law.
This requirement is prescribed under the Telecommunications, Radiocommunications and Broadcasting Regulation Act [No. 30 of 2009] (as amended), hereinafter referred to as "the Act".
Section 12(1) of the Act provides that: "A person must not provide a telecommunications service except under and in accordance with a licence or exemption."
The applicable licensing framework, including licence categories, eligibility requirements, and regulatory obligations, is further prescribed under the Operator Licence Regulation Order No. 221 of 2023.
