The Regulator had designated Digicel dominant under clause 10.3 of its Licence. Under clause 10.3 of the Licence, it provides that Digicel may request the Regulator to determine its dominance position even if Digicel has been designated dominant under clause 10.1 and 10.2 of the Licence.
In June 2009, the Regulator designated Digicel dominance (pursuant to clause 10.1&10.2 Licence) in the market for retail mobile services and wholesale market for termination of calls on Digicel’s network. Later in 2011, Digicel requested the Regulator to review the dominance under clause 10.3. After reviewing Digicel’s position in that markets, Regulator is satisfied that Digicel still dominant under clause 10.3 of the Licence.

The draft Mast Sharing Service Description document has been released for consultation in the last 2 months. TRR is pleased with the feedbacks and comments received from the Government, Can’l, TVL and Digicel on the document.
All comments were noted and given consideration and TRR is releasing the final Mast Sharing Services into the telecom market to assist Licensees and any other interested parties in their commercial negotiations.

TRR office release its third annual report (2010) which stated “ Vanuatu has been able to move forward at a rapid pace in the development of a competitive telecommunications market through the leadership of it’s Government and support of Ausaid and the World Bank".

TRR has finalized the industry’s Competition Guidelines. This Guideline outlines TRR’s approach in implementing Part 5 of the Telecommunications and Radiocommunications Regulation Act No. 30 of 2009. This Guideline also consists of the process by which Licensees should lodge a complaint with TRR regarding anti-competitive behavior, together with how TRR will proceed.
As a result of Consultation, TRR has summarized and provided feedback on Licensee’s comments.
